1. Agreement to These Terms
By accessing this website, submitting a form, contacting Kivect, or using our services, you agree to these Terms of Service. If you do not agree, you should not use this website or services.
2. About Kivect
Kivect provides marketing, design, sales support, brand strategy, content, lead generation, and related business growth services. Specific services, deliverables, timelines, and fees are defined in written proposals, statements of work, invoices, or agreements.
3. Website Use
You agree to use this website only for lawful purposes. You may not attempt to disrupt the site, misuse forms, submit malicious content, scrape data, interfere with security, or use the website in a way that harms Kivect or others.
4. No Guaranteed Results
Marketing, sales, design, SEO, advertising, and business growth work depends on many factors outside Kivect’s control. Kivect does not guarantee specific revenue, rankings, leads, conversions, sales, advertising performance, or business outcomes unless expressly stated in a separate written agreement.
5. Proposals, Fees, and Payment
Fees, payment schedules, retainers, project costs, and billing terms are provided in written proposals, invoices, or agreements. Unless otherwise stated, payments are due according to the terms shown on the invoice or agreement.
6. Refunds and Cancellations
Payments, retainers, deposits, setup fees, strategy fees, project fees, and service fees are non-refundable once work has been approved, scheduled, started, or delivered. Kivect begins work only after the client reviews the scope, approves the direction, and agrees to proceed.
Marketing, advertising, sales support, design, content, and growth services involve business risk and variables outside Kivect’s control. Because time, strategy, planning, creative work, research, execution, and account work are allocated once a project begins, refunds are not provided for change of mind, delayed client feedback, third-party platform issues, campaign performance, lead quality, sales outcomes, or business results.
If a client cancels before work begins, any refund or credit is handled at Kivect’s discretion and may be reduced by administrative costs, transaction fees, planning time, meetings, research, or any work already performed.
7. Client Responsibilities
Clients are responsible for providing timely access, information, approvals, assets, feedback, account permissions, and truthful business details required to perform the work. Delays in client response or access may affect timelines and deliverables.
8. Third-Party Platforms
Services may involve third-party platforms such as advertising networks, analytics tools, hosting providers, email platforms, CRMs, payment processors, or social platforms. Kivect is not responsible for outages, policy changes, account restrictions, review delays, pricing changes, or decisions made by third-party platforms.
9. Advertising Spend and External Costs
Advertising budgets, software subscriptions, stock assets, hosting, domains, payment processor fees, and other third-party costs are separate from Kivect service fees unless clearly included in a written agreement.
10. Intellectual Property
Unless otherwise agreed in writing, final deliverables created for and paid for by the client may be used by the client for their business. Kivect retains rights to its pre-existing materials, internal processes, frameworks, concepts, templates, tools, know-how, and non-final drafts.
11. Portfolio Use
Unless prohibited by a written agreement, Kivect may reference completed work, client name, project summary, visuals, and results as part of its portfolio, case studies, proposals, or marketing materials.
12. Content and Approvals
Clients are responsible for reviewing and approving content, claims, legal statements, offers, pricing, compliance language, and business information before publication. Kivect is not responsible for inaccurate information supplied or approved by the client.
13. Limitation of Liability
To the maximum extent permitted by law, Kivect is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from website use or services. Kivect’s total liability is limited to the amount paid to Kivect for the specific service giving rise to the claim.
14. Disclaimer
This website and its content are provided for general information. Kivect does not provide legal, financial, tax, or regulatory advice. You should consult qualified professionals for advice specific to your business.
15. Termination
Either party may terminate services according to the terms in the applicable agreement, proposal, or invoice. Outstanding fees for completed work, active retainers, third-party costs, or approved expenses remain payable unless otherwise stated in writing.
16. Changes to These Terms
Kivect may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date.
